Terms Relating to Andrew Kitt Photography.

Use Of Images: Image Licensing.

The term 'image' includes a photography, transparency, negative, design, artwork, painting, engraving, digital image file or any other item which may be offered for the purpose of reproduction; the term reproduction includes any form of publication or copying of the whole or part of any picture whether altered or not and whether by printing, photography, slide projection (whether to an audience or not), xerography, electronic or mechanical reproduction or storage. Or for any use as artist's reference or illustration, or in a layout or presentation.

If you would like to use any of the images owned by BBIL (including images used throughout the websites owned by BBIL, images taken for use in feature articles or listings on the websites owned by BBIL) please contact our Head Office to arrange a licence fee.

What is a Licence?

All our photographs are the copyright of Bishy B Industries Ltd and as such bound by our standard Terms & Conditions. Any commercial use of images requires payment of a reproduction license fee, as set out below.

There are two types of license:

Standard
- this is a "royalty-free" license, intended to cover most normal business use, for example web sites, magazines, book content, catalogues, advertising material. There is a one-time-only fee, no print run or usage time limits. Image rights are always non-exclusive and pictures may be used for any purpose except "artistic use".

Artistic
- a traditional "rights-managed" license for use where the image itself is a significant component of the end product, for example postcards, greetings cards, framed or mounted pictures, calendars or book covers. Fee is dependant on intended purpose, may be volume or time related and will usually be substantially greater than "Standard". In some cases exclusive or reserved image rights may be possible. As there is not a fixed price fee, contact us to discuss details.

The client will be invoiced as soon as the photographic shoot has been completed and must agree to pay the balance within 7 days, unless otherwise stated. Photographic images or products thereof will be released following receipt of payment.
Any invoices not paid within the 7 days of invoice, will be sent a reminder email. Payments still not received within 48 hours of the email being sent, will be subject to a £39 late payment fee and interest of 3% will be charged daily from the 14th day past invoice, until the date the payment clears our accounts.
This is as per the ‘Late Payment of Commercial Debts (Interest) Act 1998′ and applies to all contracts agreed after 7 August 2002.

Are the images available licence free?

We do not provide any of our images licence free.

Licensing Terms to Note:

Delivery of images to the Client will (unless otherwise arranged) be via email or on CD. An invoice will be posted out as a hard copy. The images are presumed to have been received in good condition unless the Client notifies BBIL in writing of any discrepancy or damage within 3 days of receipt.

The right to reproduce a picture granted by BBIL is personal to the Client and may not be assigned to any third party without prior written consent from BBIL.

The Client must accompany any reproduction of a picture with the credit line or copyright notice given on the picture's mount or caption, in the form "© Andrew Kitt Photography (year) ", unless otherwise agreed in writing by BBIL. Clients who persistently fail to credit pictures will be liable, following a written warning from BBIL, to a surcharge of 100% on the fee, for all reproductions that are not properly credited. BBIL asserts the right to a credit in accordance with sections 77 & 78 of the Copyright, Designs and Patents Act 1988.

The Client may not alter or add to or manipulate a picture by means of computer or any other technique or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without written permission from BBIL.

 

Terms Relating to PollyWiggle Promotions.

Website Design.

 

Website Hosting.

Full payment for hosting services must be made prior to hosting service being provided. In the case of a renewal for hosting services, no renewal action will be taken until payment has been received. Consequently, if the hosting for a domain is not renewed by the said date of expiry, the hosting may be deactivated and as a result any website or email accounts associated with this hosting may no longer work.

From time to time hosting services may be interrupted due to technical work or other unforeseen circumstances. BBI and associated trading names accept no liability for this occurrence or any subsequent loss of earnings/exposure as a result of the downtime.

 

 

Terms Relating to Enjoyment Membership/EnjoyMent Privilege Cards.

Membership Terms

Lifetime membership and an EnjoyMent Lifetime Privilege Card can be obtained at a cost of £10 either by purchasing online on www.enjoynorwich.com or www.enjoynorthnorfolk.com or via certain leaflets distributed by Bishy B Industries Limited.

Delivery Terms

Following subscription and receipt of payment, an EnjoyMent membership card will be dispatched via Royal Mail to the address supplied in the subscription details within 7-10 working days. Evidence of posting shall be taken as evidence of delivery.

Refunds & Returns

A Membership subscription may be cancelled at any time by written notification to the Bishy B Industries Limited at the address below. There will be no refund of monies paid, either in full or in part, whether or not the EnjoyMent membership card is returned.

Member Offers

EnjoyMent member offers are available to all members with a valid membership card; all offers are subject to availability. Please remember to take your EnjoyMent membership card out with you and show it at the selected venues in order to qualify for the particular offer.

Members Newsletter

Registered EnjoyMent members will receive an 'EnjoyMent' newsletter once a quarter, which details updated offers, features and competitions. Your email address is not sold to or shared with third parties for marketing purposes but we may invite other companies to participate in our newsletter. Replacement Cards

If you lose your card or if it is destroyed, we are happy to provide you with a replacement card. Replacement cards are charged at £5. Please enclose a cheque for that amount (made payable to Bishy B Industries Limited) when writing to report a lost or stolen card.

Terms Relating to Advertising.

A year is defined as 12 calendar months from the day the advert or Listing is published in a hard-copy production by BBIL or is live on one of the BBIL websites. 6 months is defined as 6 calendar months from the day the advert is published. One month is defined as 1 calendar month from the day the advert is published.

All copy, pictures, and the final advert can be pre-approved by the advertiser before publication.

Our policy on advertising is strict in so far as the quality of any advert or message must be in keeping with the website style and general presentation. We reserve the right not to process or include material, which is in our opinion unsuitable for inclusion.

All advertising on the websites begins with a signed Insertion Order. The client will be invoiced as soon as the listing or advert is ‘live’ and must agree to pay the balance within 7 days, unless otherwise stated.

BBIL does not advertise the following: tobacco products, illegal substances, businesses or products known to exploit people or animals, weapons or businesses that manufacture or sell weapons or tools of war, businesses that are believed to or found to engage in illegal practices.

BBIL reserves the right to preserve the user experience of the website, and reserves the right to remove any advertisement which is deemed annoying, offensive and/or harmful to our users at any time.

BBIL makes no guarantee regarding the levels of impressions or clicks for any advert on any of the websites owned by BBIL, nor the business gained through such advertising.

An advertising agreement may be cancelled at any time by written notification to BBIL. A cancelled advert may continue to run for up to 24 hours before such cancellation takes complete effect. There will be no refund of monies paid for adverts cancelled or removed before the originally agreed run duration. Naturally, BBIL will do all that we can to ensure that a mutually agreeable outcome is reached in the event of any dissatisfaction.

Any notice or correspondence from BBIL to you may be delivered by e-mail or post to you at your last known address. Evidence of posting (either electronically or otherwise) shall be taken as evidence of delivery. This agreement shall be governed by English Law.

Participants in the EnjoyMent Card/Membership scheme are expected to honour their originally agreed offer (defined in wiring prior to publication) for the duration of their participation in the scheme. Failure to honour their offer may result in their removal from the scheme with minimum notice. In such an event no monies already paid will be refunded.

Participation in the EnjoyMent Membership scheme is reviewed annually although participants may withdraw from the scheme at any time by giving written notification to BBIL. There will be no refund of monies paid for cancellation of participation before the originally agreed run duration.

 

Law and Jurisdiction

Your use of this website, these terms and any matters arising are subject to the laws of England. Any dispute is subject to the exclusive jurisdiction of the Courts of England.
